Spouse/Partner Work Permit

When one of the spouses is an international student studying in Canada, a resident holding a temporary work permit, or a Canadian citizen/permanent resident, the spouse can apply for an open work permit. Details are as follows:

Study visa spouse

Your spouse can apply for an open work permit if you hold a study permit to study at the following schools:
1. Public higher education institutions (colleges or universities),
2. Private higher education institutions recognized by the Quebec government,
3. The Quebec government Recognized public and private vocational training schools,
4. Private institutions that can issue degrees (bachelor, master, doctorate), and the applicant is enrolled in a program that will eventually issue a degree certificate.
Except for Quebec, post-secondary certificates or diplomas issued by private institutions in other provinces are not eligible for a spouse work permit.
If your spouse is a full-time student in Canada, you cannot apply for a spouse work permit.

If you hold a work permit and
1. You have NOC   0, A or B work and the employer has committed to provide work for at least 6 months, or
2. You have NOC   C or D work and have obtained The corresponding provincial nomination certificate or Quebec CSQ, or
3. You have submitted an application for Canadian experience immigration, and applied for a work permit for your spouse at the same time as applying for a bridge work permit.
Then your spouse can get a work permit. Please note that in most cases if you are only on a work permit and are not working in NOC   0, A or B work, your spouse will not be able to obtain a work permit.

Spouse of Citizen or Permanent Resident

The spouse of a citizen or permanent resident can apply for an open work permit if he/she has submitted a reunion immigration application in the country and the status is legal.
Please note that only domestic reunions are eligible for a spouse work permit, and overseas reunions are not. It is even more inappropriate to submit an application for reunion immigration.
If the applicant's status has expired, they can apply for an open work permit after the reunification immigration approval in principle (AIP).

Validity period

The validity period of the study permit and work permit holder’s spouse’s work permit is usually the same as that of the study permit and work permit. The validity period of the reunited immigrant spouse work permit is usually 2 years.

How to apply

· Domestic reunited immigrant spouse work visas cannot be applied for overseas or at the border. Spouses of study and work permits can apply for work permits abroad, at the border, or within the country.

· It is recommended that spouses apply for tourism and family visit visas first, and then enter the country to apply for spouse work visas, because there is a very high visa rejection rate overseas, while domestic visas are rarely rejected. The border application depends on the mood of the officials at the time. In the worst case, it may be deported, which is more risky and is not recommended to try.

· The benefit of a border application is that it can be picked up on the spot, but it usually takes 1-3 hours to drive to the US/Canada border to get a work permit.

· The advantage of applying online is that the application is only submitted online, and the work permit will be sent to the applicant's home, but it will take several weeks or even longer to process.
